1. Acceptance of Terms

By accessing or using WhereToAdvisor (the "Service"), operated by Bite Size Elephant LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Changes take effect when posted to the Service. Continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

WhereToAdvisor is an informational tool that aggregates publicly available data to generate comparative scores for international destinations. The Service provides general guidance to help users research potential relocation destinations. The Service does not provide immigration advice, legal counsel, financial planning, tax guidance, or any other form of professional advice.

3. Informational Purposes Only

All content, scores, rankings, and recommendations provided through the Service are for informational and educational purposes only. They are not a substitute for professional advice from qualified immigration attorneys, financial advisors, tax professionals, real estate agents, or other licensed professionals.

You acknowledge and agree that:

(a) Destination scores are derived from third-party data sources that may contain inaccuracies, may be outdated, or may not reflect current conditions on the ground.

(b) Scores represent statistical aggregations and do not account for individual circumstances, personal preferences, or factors not captured by our data sources.

(c) Conditions in any destination may change rapidly due to political events, natural disasters, economic shifts, legislative changes, public health emergencies, or other factors beyond our control.

(d) The Service does not verify, endorse, or guarantee the accuracy, completeness, or timeliness of any information provided.

4. No Guarantee of Outcomes

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT BITE SIZE ELEPHANT LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SUITABILITY, SAFETY, LIVABILITY, OR DESIRABILITY OF ANY DESTINATION PRESENTED THROUGH THE SERVICE. YOUR DECISION TO RELOCATE TO ANY DESTINATION IS MADE ENTIRELY AT YOUR OWN RISK AND DISCRETION.

Without limiting the foregoing, we do not guarantee or warrant:

(a) That any destination will meet your expectations, needs, or preferences.

(b) That conditions described by the data will remain stable or unchanged after you access the Service.

(c) That scores accurately reflect your personal experience in any destination.

(d) That the data sources we rely upon are free from errors, bias, or omissions.

(e) That the Service will be available without interruption or error.

5. Assumption of Risk

International relocation involves inherent risks including but not limited to: changes in immigration law, political instability, civil unrest, terrorism, armed conflict, natural disasters, pandemics, economic downturns, currency fluctuations, changes in cost of living, discrimination, language barriers, cultural adjustment difficulties, loss of social support networks, and inadequate healthcare access.

You assume full responsibility for any and all risks associated with decisions made based on information obtained through the Service, including any financial losses, physical harm, emotional distress, or other damages that may result from relocation.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITE SIZE ELEPHANT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF THE AMOUNTS YOU HAVE PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

7. Indemnification

You agree to indemnify, defend, and hold harmless Bite Size Elephant LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

(a) Your use of the Service.

(b) Any relocation decision made based on information obtained through the Service.

(c) Your violation of these Terms.

(d) Your violation of any applicable law or regulation.

(e) Any claim by a third party arising from your actions or omissions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9. Third-Party Data Sources

The Service aggregates data from third-party sources including but not limited to: Transparency International, Freedom House, Numbeo, the World Bank, Heritage Foundation, UNODC, IQAir, OECD, Equaldex, and the Social Progress Index. We are not affiliated with, endorsed by, or responsible for the accuracy of data from these sources.

Each data source has its own methodology, update schedule, and limitations. We normalize and aggregate this data but do not independently verify it. Changes in third-party data availability, methodology, or accuracy may affect the Service without notice.

10. User Accounts and Payment

Certain features of the Service require payment. All payments are processed through Stripe. You agree to provide accurate billing information and authorize us to charge the applicable fees.

Paid reports are digital products delivered electronically. Due to the nature of the product, refunds are provided at our sole discretion. You may request a refund within 14 days of purchase by contacting us.

11. Acceptance and Inclusion Scores

The Service includes an "Acceptance" scoring facet that evaluates legal protections, social attitudes, and safety conditions for various demographic groups in each destination. These scores are based on publicly available data and are intended to help users assess personal safety and legal protections.

Acceptance scores are personalized estimates, not guarantees of safety or inclusion. Conditions vary by region, city, neighborhood, and individual circumstance. A high acceptance score does not guarantee safety, and a low score does not mean a destination is necessarily unsafe for you.

12. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, scoring methodologies, and software, are owned by Bite Size Elephant LLC and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Service without our prior written consent.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy for information about how we collect, use, and protect your data.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without prior notice. Upon termination, your right to use the Service ceases immediately. Sections 3 through 8 survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia. You consent to personal jurisdiction in these courts.

Before filing any claim, you agree to attempt resolution by contacting us in writing. Both parties agree to negotiate in good faith for at least thirty (30) days before initiating formal proceedings.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver. These Terms constitute the entire agreement between you and the Company regarding the Service.
